This Agreement describes the terms and conditions applicable to your use of our services available under the domain PoultryList.com (the "Site") the general principles for the websites of our subsidiaries. If you do not agree to be bound by the terms and conditions of this Agreement, do not use or site. You must read, agree with and accept all of the terms and conditions contained in this User Agreement before you may become a member of our site. We strongly recommend that, as you read this User Agreement, you also access and read the information contained in the other pages and websites referred to in this document, as they may contain further terms and conditions that apply to you as sire member. Please note: underlined words and phrases are links to these pages and websites. We may amend this Agreement at any time without notice.

1. Release
We only provide services to people interested in selling and buying via the internet. We do not have control over the items that are posted in the site and cannot guarantee the authenticity and quality of a said product. We are not responsible for the actions the users take, before, during, and/or after the sale, typographical errors, misprints, loss of merchandise/money, damage or failure of equipment, due to your visit to this site. Use of this site is at your own risk, and content is presented 'As-Is'. Because we are a venue, in the event that you have a dispute with one or more users, you must hold the owners of this site harmless from all claims arising out of any dispute between a buyer, seller or any other user of this site. We serve as an agent to facilitate transactions between buyers and sellers. We are not responsible for anything contained in the item listings or feedback. In no way may the owners of this site be held liable for improper use by users. We will not be held responsible for any loss or damages caused by errors by the system or the Internet. PoultryList.com is not responsible for any loss sales, data, or information due to problems caused by any technical difficulties.

2. Information Control
We occasionally control the information provided by other users that is made available through our system. You may find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using the Site. Please note that there are also risks of dealing with underage persons or people acting under false pretense. By using this Site, you agree to accept such risks and PoultryList is not responsible for the acts or omissions of users on the Site. If an item that has been listed appears to be offensive, harmful, inaccurate, or deceptive, you have the capibility to report that item to PoultryList by selecting "Report Item" in the listing. You must be a registered user and be logged in to report an item.

3. Membership Eligibility
Our services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Our site is available to children (persons under the age of 18). If you are under the age of 18, you can use this service only in conjunction with, and under the supervision of your parents or guardians. Upon registration, you will be asked for your parent's/guardian's email address . You must register under your true name (first and last), true mailing address, and true phone number using a valid email address. If any information is found to be fraudulent or the user is found to be unable to form a binding contract, the user will be suspended.

4. Fees and Services
Joining, buying and placing wanted items at PoultryList is free. Sellers pay applicable fees for listing items through our Site and when you list an item you have an opportunity to review and accept the fees that you will be charged. We may change our Fees and Credits Policy and the fees for our services from time to time. Please go to our Fee Schedule for more information.

4. Buying
We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. We cannot ensure that a buyer or seller will actually complete a transaction. Release. Bidding and Buying. As a buyer, you are obligated to complete the transaction with the seller: By selecting "Purchase Now" you agree to be bound by the conditions of sale included in the item's description so long as those conditions of sale are not in violation of this Agreement or unlawful.

5. Selling, Posting Wanted Ads and Posting Notices
Listing Description.
You must be legally able to sell the item(s) you list for sale on the Site. You must describe your item and all terms of sale on the listing page of the Site. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of that item. All listed items must be listed in an appropriate category. All items in multiple item listings must be identical. You may not list for sale cage birds such as Parrots or their hatching eggs for sale.
Fraud.
Without limiting any other remedies, We may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site. We reserve the right to edit or remove any auction listing at any time without notice.
User Responsibility
It is your responsibility to learn and understand the shipping regulations and policies set forth by the NPIP program, United States Postal Services, and any other shipper, agency, or governing body concerned with the transfer/shipping of animals or merchandise. Prior to listing items/birds for sale or buying an item/bird please check and comply with State Regulations. PoultryList will not be responsible for any failure to comply with these regulations. You further agree that the owners of PoultryList will not be held liable in the event of prosecution pertaining to lack of compliance with above stated regulations and policies. Each seller shipping birds must use USPS approved shipping containers approved for that type of bird. When using such containers, it must be filled with no more than what the container's specifications allow. All containers must be in good condition. You may not ship hatching eggs or birds outside of the United States. Failure to comply with the "User Responsibility" can result in permanent suspension to the site.

6. Feedback/Integrity
You may not take any actions that may undermine the integrity of the feedback system. When you place purchase, you have the ability to score your seller on their performance and leave a comment. We encourage all customers to leave feedback--if it's positive, it means a lot to the seller. If it's negative, it means a lot to your fellow shoppers. Feedback can only be given to sellers. The seller rating system is 1 to 5 stars, with 5 stars being the best. A seller's average rating will appear alongside their name on our site. If you're tempted to leave a critical rating, make sure that you've given the seller every chance to resolve the issue first. Contact information for your seller appears in the email received confirming your purchase. If a seller has received a rating of -5, he/she may be banned from the site.

7. Users Outside the US
Users Outside of the United States may not participate in the sell or buying of hatching eggs or birds. You may place wanted ads or notices.

8. Privacy
We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. We view protection of users' privacy as a very important community principle. We understand clearly that you and your information is one of our most important assets. Please review the Privacy Policy.
